Abstract
As artificial intelligence systems become increasingly autonomous and pervasive across industries, the legal landscape faces unprecedented challenges in determining liability and accountability when these systems cause harm. This article examines the evolving regulatory framework surrounding AI liability, analyzing current legislative developments, the complexities of establishing fault and causation in AI-related incidents, and the emerging legal doctrines that courts and legislators are developing to address these challenges. With the European Union’s AI Act entering force in 2024 and various U.S. states enacting comprehensive AI legislation, the legal profession must grapple with fundamental questions about responsibility, insurance, and compensation in an age where algorithms make decisions that affect human lives and property.
Introduction
The rapid proliferation of artificial intelligence systems across healthcare, transportation, finance, and other critical sectors has created a legal conundrum that traditional tort law was never designed to address. When an autonomous vehicle causes an accident, a medical AI system misdiagnoses a patient, or an algorithmic trading system triggers market volatility, determining legal responsibility becomes extraordinarily complex. The traditional concept of liability, rooted in human agency and foreseeability, struggles to adapt to systems that learn, evolve, and make decisions in ways that even their creators cannot fully predict or understand.
This challenge has intensified as AI systems transition from simple automation tools to semi-autonomous and fully autonomous agents capable of making decisions without direct human intervention. The legal system’s response has been fragmented and evolving, with different jurisdictions adopting varying approaches to AI liability. The stakes could not be higher, as the resolution of these legal questions will shape the future of AI development, deployment, and societal acceptance.
The Current Regulatory Landscape
Global Developments in AI Governance
The regulatory response to AI liability has been remarkably swift by legal standards. The AI Act entered into force on 1 August 2024, and will be fully applicable 2 years later on 2 August 2026, with some exceptions: prohibitions and AI literacy obligations entered into application from 2 February 2025. This landmark legislation represents the world’s first comprehensive framework for AI governance, establishing risk-based categories and specific liability provisions for high-risk AI systems.
The European approach emphasizes prevention through strict compliance requirements, mandatory risk assessments, and ongoing monitoring obligations. High-risk AI systems, including those used in healthcare, transportation, and law enforcement, face particularly stringent requirements that effectively create a presumption of liability when systems fail to meet regulatory standards.
United States Legislative Response
The American approach has been more decentralized, with state legislatures taking the lead in the absence of comprehensive federal legislation. In the 2024 legislative session, at least 40 states, Puerto Rico, the U.S. Virgin Islands and the District of Columbia introduced artificial intelligence (AI) bills, and six states, Puerto Rico and the U.S. Virgin Islands adopted resolutions or enacted legislation. This patchwork of state laws creates a complex compliance environment for businesses operating across multiple jurisdictions.
On May 17, 2024, Colorado enacted the first comprehensive US AI legislation, the Colorado AI Act, which establishes specific liability provisions for algorithmic discrimination and requires companies to implement reasonable care standards in AI system design and deployment. The Colorado model has influenced subsequent state legislation, creating a template for AI liability that other states are adapting to their specific needs.
However, the regulatory landscape shifted significantly with the change in federal administration. As of January 20th, 2025 –as promised by current President Donald Trump during his previous election campaign– these efforts have been revoked, referring to previous executive orders on AI governance. This reversal has placed greater emphasis on state-level regulation and common law development through court decisions.
Theoretical Foundations of AI Liability
The Challenge of Autonomous Agency
Traditional tort law is predicated on the concept of human agency and the ability to establish fault through negligence, intentional misconduct, or strict liability principles. Insurance-Based Solutions: Some jurisdictions are exploring mandatory insurance requirements for AI systems, similar to automobile insurance. This approach ensures victim compensation while distributing risk across the insurance industry, but it requires sophisticated actuarial models for emerging technologies.
Industry-Specific Liability Challenges
Healthcare AI
The healthcare sector presents unique liability challenges due to the life-or-death nature of medical decisions and the complex interplay between AI systems and human medical professionals. When an AI diagnostic system misidentifies a malignant tumor or an AI-powered surgical robot causes injury, determining liability requires analyzing the roles of the software developer, healthcare provider, and attending physician.
Medical malpractice law traditionally focuses on the standard of care exercised by human practitioners. AI systems complicate this analysis by introducing new standards based on algorithmic performance, training data quality, and system validation. Courts must grapple with questions such as whether physicians have a duty to override AI recommendations and whether AI systems can establish new standards of care that human practitioners must follow.

The challenge lies in determining responsibility among multiple parties: the vehicle manufacturer, software developer, sensor manufacturer, and human driver (if any).
Different levels of autonomous driving create distinct liability scenarios. In Level 2 systems, where human drivers remain responsible for monitoring and intervention, liability may follow traditional negligence principles. However, Level 4 and 5 systems, where human intervention is not expected or possible, require new liability frameworks that account for the autonomous nature of vehicle operation.

AI systems in financial services can cause significant economic harm through algorithmic trading errors, biased lending decisions, or fraudulent transaction processing. The challenge lies in quantifying harm, establishing causation, and determining appropriate remedies for different types of financial losses.

AI liability cases require sophisticated technical evidence that traditional legal practitioners may struggle to understand and present effectively. Courts must grapple with complex algorithms, training data sets, and system performance metrics that are often proprietary and difficult to access.
