The Supreme Court has already embraced AI through initiatives like SUPACE (Supreme Court Portal for Assistance in Court’s Efficiency), which uses machine learning for case management and legal research. Various High Courts have implemented virtual court systems, e-filing platforms, and AI-assisted translation services to improve accessibility. These innovations align with the constitutional mandate of ensuring speedy justice under Article 21.
However, the integration of AI raises fundamental constitutional challenges. Article 14 guarantees equality before law, yet AI algorithms trained on historical data may perpetuate existing biases against marginalized communities, women, and minorities. The “black box” nature of many AI systems conflicts with principles of transparency and natural justice litigants have the right to know how decisions affecting their liberty and property are made.

The analysis identifies key areas where AI deployment shows promise: case categorization and prioritization, legal research assistance, virtual hearings, automated translation services, and judicial administrative support. These applications align with constitutional mandates under Articles 21 and 39A to ensure accessible, affordable, and timely justice.
However, significant constitutional concerns emerge regarding algorithmic bias, transparency, accountability, and the preservation of fundamental rights. Article 14’s equality guarantee may be undermined by AI systems that perpetuate historical discrimination against marginalized communities. The right to fair trial under Article 21 faces challenges from opaque algorithmic decision-making that prevents meaningful participation and challenge by affected parties.
