- Tortious Liability: The obligation to pay damages for a civil wrong (in this case, the creation of a deepfake).
- Prima Facie: At first sight; used here to determine if the synthetic media is convincingly enough fabricated to deceive a reasonable observer.
- Malice: The intent to do harm, which is a critical element in proving “Actual Malice” in defamation cases involving public figures.
- Injunctive Relief: A court order requiring a party to do or refrain from doing a specific act (e.g., removing a deepfake from the internet).
- Right of Publicity: The inherent right of an individual to control the commercial use of their name, image, and likeness.
- Strict Liability: A legal doctrine that holds a party responsible for their actions regardless of intent, which is often proposed for AI developers who fail to watermark synthetic content.

- Expedited Injunctive Proceedings: Establishing “Fast-Track Courts” for deepfake victims, where a prima facie showing of non-consensual synthetic media leads to an immediate take-down order within 24 hours.
Ultimately, the law must shift from punishing the “lie” to protecting the “identity.”
