Vijay Mallya and the Kingfisher Airline case is one of the most infamous scandals in India. Vijaya Mallya was an Indian businessman and former politician, popularly known as “King of Good Times” who was accused of committing large-scalefinancial fraud, money laundering and bank loan defaults. He was charged of fraud and money laundering after obtainingRs.9000 crore in loans from a consortium of seventeen Indian banks, including legal public sector. Facing the fear ofinvestigations and arrest, Malaya left India in 2016 and fled to the United Kingdom as he became India’s one of the high-profile economic offenders. The case became one of the biggest examples of corporate governance failure and irregularities in bank system.

➢ Criminal conspiracy: As per Section 120A of the Indian Penal Code (IPC) it is defined as,
o It is an agreement between two or more personscommits an unlawful act or to do a lawful act through unlawful means.
➢ Wilful Default: A ‘wilful default’ occurs when any of the four following circumstances:
o When the borrower has the deliberate intention not to repay or pay obligations despite having the financial capacity to do.
o When the borrower defaults on its payment / repayment obligations to the lender and uses the funds obtained from the lender for the specific purposes other than those for which the loan sanctioned, thereby diverting the funds.
o The borrower defaults on its repayment and siphons off the borrowed funds, which means money is neither used for its intended purpose nor remains available with the borrower in the form of identifiable assets.
o The borrower defaults on its payment or repayment obligations to the lender and has selled, transferredor removed the movable fixed assets or immovable property given for the purpose of security of theterm loan without the informing the bank or lender.
➢ Fugitive Economic Offender: Under Section 2(f) TheFugitive Economic Offenders Act, 2018, “fugitive economic offender” means an individual against whomarrest warrant in for Scheduled Offence has been issued by any Indian Courts, who has left India evade criminal prosecution; or being any foreign nation, deliberately refuses to return to India to face legal proceedings.
The Proof
Vijay Vittal Mallya was born on 18 December 1955 in Bantwal, Mangalore, Karnataka. He is the son of Vittal Mallya and Lalitha Ramiah from. He completed his graduation in BA Bachelors of Commerce (Honours) Degree in St. Xavier’s College, in 1976.
At the age of 28, he started his career at United Breweries, an established multinational conglomerate comprising over 60 companies. He launched Kingfisher Airlines in May 2005, offering both domestic and international services. However, the success proved to be a flash in the pan. As in 2007, the airline acquired Air Deccan (later rebranded as Kingfisher Red) for approximately ₹550 crore in an attempt to expand into the low-cost aviation market. By 2009, there was net loss of RS. 418.77 crore and 100 pilots were laid off due to theglobal financial crisis and rising fuel costs. To operate his business, he obtained heavy loans from several banks but failed to repay them. He took loan from a consortium of 17 banks for Rs.9000 crore and SBI State Bank of India (SBI)was the major part of it.
The fortune changed drastically after it faced losses exceedingRs.7000 crore loss to the company, as the Kingfisher Airlines finally suspended all its operations in October 2012 and with 15 months of unpaid salary and provident fund (PF) dues to employees. The company also defaulted in paying taxes to the government.
During the investigation, it was known that Sathish Mishra (General Manager of IOB), Suhas Bhat (Managing Director of IOB), Anil Bansal (Executive Director of IOB), Narendra Mairpady (competent authority at IOB).
On 2016, after the scam, he ran to the United Kingdom and stayed there forever. He denied all the allegations and started avoiding all the legal proceedings. Since then, multiple agencies initiated investigations against him.
• CBI: Investigated allegations of criminal conspiracy and bank fraud

• Debt Recovery Tribunal: Accessed and determined recoverable dues running into several thousand crores.
• Supreme Court: Mallya was Sentenced for contempt of court in 2022.
In 2019, Mallya was officially declared as “Fugitive Economic Offender” by Indian government to seize the assets even without a conviction.
Abstract
The Vijay Mallya, Kingfisher Airlines case is one of the most prominent financial fraud cases in India, exposing weaknesses in corporate governance, banking practices, and financial accountability. Kingfisher Airlines, once a leading private airline, faced severe financial difficulties after rapid expansion and rising operational costs. To sustain its business, the company borrowed substantial amounts from a consortium of Indian banks but failed to repay the loans. Investigations later revealed allegations of fund diversion, money laundering, and other financial irregularities. Following the collapse of the airline, Vijay Mallya left India in 2016 and became the subject of multiple legal proceedings initiated by Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED)agencies. Judge: Hon’ble Shri S.P. Naik-Nimbalkar, Special Judge (CBI)
Facts: The CBI filed a charge sheet against Vijay Mallya and others for offences involving criminal conspiracy, cheating, and corruption. CBI requested issuance of an open-ended Non-Bailable Warrant instead of a summons, under Sections 204 and 87 CrPC.
Held: The Special CBI Court held that Section 87 CrPC permits issuance of a Non-Bailable Warrant in lieu of a summons where the court has reason to believe that the accused has absconded or disobeyed the summons.
2. State Bank Of India vs Dr. Vijay Mallya on 11 July, 2022.
Judge: Pamidighantam Sri Narasimha, S. Ravindra Bhat, Uday Umesh Lalit
This case was led by State Bank of India on behalf of group of banks. SBI initiated recovery proceedings against Dr. Vijay Mallya for unpaid debts. Although court orders prohibited him from transferring his assets and required him to disclose them fully, he received US$40 million from Diageo and transferred the money to trusts established for his children. The Supreme Court had already held that these actions amounted to contempt of court, and the present proceedings concerned the appropriate punishment and consequential relief.
Held: The Supreme Court held that a person found guilty of contempt cannot simply face punishment while retaining the benefits gained through disobedience of court orders. The court sentenced Vijay Mallya to four month jail term and wasfined. The Court also declared the transfer of the US$40 million to the trusts void, directed that the money be repaid with interest, and authorized recovery proceedings if the amount was not returned.
Conclusion
The Vijay Mallya–Kingfisher Airlines case remains one of the most significant corporate financial fraud cases in India. It exposed serious shortcomings in corporate governance, banking oversight, and the monitoring of large corporate loans. The collapse of Kingfisher Airlines resulted in substantial financial losses to a consortium of banks, employees, and other stakeholders, leading to multiple criminal and civil proceedings against Vijay Mallya. Investigations by CBI, ED, and the SFIO, andwith his declaration as a Fugitive Economic Offender, demonstrate the legal consequences of financial misconduct and wilful default. The case also led to significant reforms in India’s banking and financial sector, resulting in stricter lending practices, enhancedmechanisms for loan recovery, and stronger legal measures to address economic offences. It continues to serve as a landmark example of the importance of transparency, accountability, and responsible corporate governance in protecting the interests of financial institutions and the public.
