A bench of Justice Anil R. Dave, Kurian Joseph, R. Banumathi of the Supreme Court of India delivered a relevant dictum while hearing this case. Observing that CCTV footage was to be considered as the best piece of evidence in order to prove the presence of the accused at the crime scene and it was for the prosecution to produce such evidence. The Supreme Court ruled that secondary proof of details in a report can be taken through Section 65 of the act in a criminal trial where CCTV footage is required.
