INTRODUCTION
Bellamy v. Sabine is a landmark case in which Justice Turner found the Doctrine of Lis Pendens. The doctrine, also known as the “pendente lite” principle, is mentioned under Section 52 of the Transfer of Property Act, 1882 (TOPA). This section states that during the pendency of litigation affecting the title to immovable property, any transfer of such property by any party to the litigation is void against any person who may be subsequently adjudged to have an interest in the property. Essentially, lis pendens prevents the transfer of property rights while legal proceedings are ongoing, ensuring that the outcome of the litigation is not prejudiced by the actions of the parties involved. Bellamy v. Sabine solidified the application of this doctrine in English property law, emphasizing its importance in maintaining the stability and fairness of property rights during legal disputes.
FACTS OF THE CASE
The case of Bellamy vs Sabine involves a dispute over the ownership of an immovable property.
