However, these laws often raise concerns about free speech and misuse of power. There is a thin line between regulation and censorship. For example, India’s Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, require platforms to appoint grievance officers, trace the origin of messages, and respond swiftly to government takedown requests. Similarly, the European Union’s Digital Services Act focuses on content moderation, transparency, and user protection.


On the other hand, these laws raise serious concerns about surveillance, censorship, and misuse of power. In some cases, governments may exploit these regulations to suppress dissent, stifle free speech, or target critics. Vague definitions of what constitutes “unlawful” or “anti-national” content can lead to arbitrary content removal and fear among users. Increase in Fake News and Misinformation
Case Example: During the COVID-19 pandemic, India witnessed a surge in fake cures and conspiracy theories spreading like wildfire on WhatsApp and Facebook.

Traceability Clause – A rule that allows the government to trace the “first originator” of a message, especially in cases of fake news or criminal content. Critics argue it may compromise end-to-end encryption and user privacy.

However, these laws must not become tools for censorship or political control. There is a very fine line between regulation and suppression. In such cases, the law becomes a threat to the very democracy it seeks to protect.
