THE SOCIO ECONOMIC RESILIENCE OF WOMEN POST DIVORCE :  A STUDY OF CHALLENGES AND TRIUMPHS WITH SPECIAL REFERENCE TO THE HINDU LAW

INTRODUCTION

  1.  Introductory 

Divorce, which was once a forbidden topic, is now a major social phenomenon. Divorce is the legal conclusion of a legally and socially accepted marriage relationship, which radically alters the roles and duties of the parties. Divorce is a major life change with lasting and far-reaching consequences. It affects every aspect of life, from social relationships to mental well-being, legal status, self-image, and financial security. Therefore, divorce is the legal termination of a marriage by a court. — Also known as marital dissolution; dissolution of marriage.[ Black’s Law Dictionary (9th edn, 2009).] Hindu marriage has historically been regarded as a sacred and permanent union, firmly rooted in religious, social, and cultural traditions. Therefore, divorce tends to be decried, with marriage being viewed as a permanent institution and a bond that should last lifetimes. This viewpoint results in a major challenge for women divorced, who can face serious consequences, such as economic instability, social ostracism, and loss of personal autonomy. In India, Hindu Marriage Act, 1955 provides Hindu women with the right to maintenance and alimony after divorce, guaranteeing economic sustenance, while Hindu Succession (Amendment) Act, 2005 guarantees inheritance rights, resolving property conflicts and enhancing their economic security and social well-being.

Yet, even with these legal changes, Indian divorced women are still subject to on-going monetary struggles and social exclusion, pointing to the disparity between legislative advances and actual implementation. The current study explores these issues by critically examining current legal provisions and their efficacy in facilitating women after divorce. In addition, it delves into the convergence of law, culture, and economics to present a full picture of the intricacies faced by divorced women in India. Through the study of these highly complex issues, this research aspires to make a contribution toward gender justice discourse and highlight the need for stronger support systems to facilitate divorced women in overcoming the challenges they encounter.
