Unprecedented responsibility attribution issues in tort law are brought forth by the quick adoption of AI technologies throughout industries. When applied to autonomous decision-making systems, traditional negligence doctrines, product liability frameworks, and vicarious liability concepts must be fundamentally rethought. The controversial issue of AI legal personhood, stringent liability regimes, and algorithmic accountability requirements are some of the new jurisprudential approaches to AI liability that are examined in this paper. This paper makes the argument for comprehensive liability frameworks that maintain the established concepts of causation and foreseeability while balancing innovation incentives and victim recompense through an analysis of landmark case law and legislative developments.

Legal scholars refer to the incorporation of artificial intelligence into crucial decision-making processes as a “liability gap”—a legal void where conventional theories of causation, proximate cause, and culpability are insufficient to address harm caused by autonomous systems. AI systems function through machine learning algorithms that produce outcomes that are neither expressly programmed nor reasonably anticipated by their authors, in contrast to traditional product liability situations that preserve traceable human agency across the causal chain.
This paradigmatic shift necessitates fundamental re-examination of cornerstone legal principles: the doctrine of respondeat superior, negligence’s reasonable person standard, and the conceptual framework of legal agency itself. Courts increasingly confront cases where proximate cause lies not in human error but in emergent behaviour of neural networks operating beyond direct human oversight.

A. Standard of Care Challenges
The reasonable person criterion, which is used in traditional negligence analysis, requires courts to decide whether the defendant’s actions were below the standards of expected care. AI systems provide particular difficulties for this anthropocentric paradigm:
Analysis of Foreseeability: When it comes to proving the foreseeability prongs of negligence claims, the opaque nature of machine learning algorithms presents evidentiary challenges. Traditional Palsgraf v. Long Island Railroad rules of proximate causation are difficult for courts to apply when neural networks make choices through opaque methods.
Professional Standards: Courts usually respect industry norms and professional standards in malpractice cases.
