Abstract

 

Deepfake technology is one of the fastest-growing applications of Artificial Intelligence (Al). It can create highly realistic fake images, videos, and audio recordings that are often difficult to distinguish from real content. Although this technology has many useful applications, its misuse has become a serious concern. It is being used for identity theft, online fraud, spreading misinformation, damaging reputations, and violating an individual’s privacy. At present, India does not have a specific law that directly regulates deepfake technology, but legal action can be taken under existing laws depending on the nature of the offence. This article explains the concept of deepfake technology, its legal challenges, relevant case laws, and the need for stronger legal protection and public awareness to prevent its misuse.

Due to the increasing use of deepfakes, the images and videos of many high-profile individuals have been misused. Scammers have circulated deepfake videos of businessmen such as Ratan Tata and Narayana Murthy, as well as public figures like Rashmika Mandanna and many others.

 

As a result, victims have faced serious consequences such as reputation damage, privacy violations, financial fraud, and the spread of fake news.

 

The Government of India has taken several important steps to address this issue by issuing advisories to social media platforms and digital intermediaries, asking them to identify and remove deepfake content and take appropriate action against its misuse. However, the increasing use of deepfake technology shows that stronger legal measures and greater public awareness are still required.

1. Anil Kapoor v. Simply Life India & Others (2023)

In this case, actor Anil Kapoor approached the Delhi High Court because his name, image, voice, and personality were being misused through Artificial Intelligence (AI) and deepfake technology. The Court protected his personality rights and restrained the unauthorised use of his identity. This case became an important step in protecting individuals from the misuse of AI-generated content.

 

 

2. Amitabh Bachchan v. Rajat Nagi & Others (2022)

In this case, Amitabh Bachchan filed a case before the Delhi High Court against the unauthorised use of his name, image, voice, and personality. The Court held that no one can use a person’s identity without permission for commercial purposes. This judgment also helped protect personality rights in the digital world.

 

3. Justice K.S. Puttaswamy v. Union of India (2017)

In this landmark case, the Supreme Court recognised the Right to Privacy as a Fundamental Right under the Constitution of India.
