The central challenge lies in finding equilibrium: safeguarding the fundamental right to free speech while curbing the misuse of these platforms for political manipulation and disinformation campaigns. With states, courts, and tech companies grappling over regulation, the question remains: How do we regulate social media without stifling democracy?
This article explores this dilemma by analyzing constitutional principles, legal doctrines, statutory frameworks, and judicial precedents from India and abroad. It evaluates the current gaps, highlights the dangers of under-regulation and over-regulation, and proposes reforms to strike a balance between freedom and accountability in the age of digital politics.

Social media has emerged as both a democratizing tool and a destabilizing force in contemporary politics. While it amplifies citizen voices and facilitates free expression, it also enables the unchecked spread of political propaganda, fake news, and extremist ideologies. Governments worldwide are struggling to design regulatory mechanisms that curb harmful content without infringing on constitutional rights to free speech.
This article critically examines the legal challenges of social media regulation, focusing on the tension between free speech and political propaganda. It explores doctrines of reasonable restrictions, intermediary liability, algorithmic accountability, and electoral integrity. Drawing on key judgments like Shreya Singhal v. Union of India, Anuradha Bhasin v. Union of India, and international precedents such as Brandenburg v. Ohio and Twitter v. Taamneh, it highlights how courts and regulators address this complex intersection.
The article concludes that a nuanced, balanced, and transparent legal framework is essential to protect democratic freedoms while preventing misuse of social media for political manipulation.

3. The Regulatory Gap
India: IT Rules 2021 mandate grievance officers, originator-traceability, and takedown obligations. Critics argue these empower the state excessively, risking censorship.
United States: Section 230 protects platforms but is under bipartisan attack for shielding tech giants from accountability.
European Union: The Digital Services Act (2022) imposes obligations for algorithmic transparency, rapid takedown of illegal content, and restrictions on targeted political ads.
No jurisdiction has fully solved the dilemma—over-regulation chills speech, under-regulation enables propaganda.

In 2015, India, Shreya Singhal v. Union of India  In the IT Act, “offensive” internet communications were made illegal by Section 66A.  Question: Do ambiguous controls on internet speech infringe against the right to free speech?  In its ruling, the Supreme Court declared Section 66A unconstitutional due to its ambiguity and chilling impact.  Principle: Article 19(2) must rigorously apply to restrictions on digital expression.
The case of Anuradha Bhasin v. Union of India (India, 2020)  Factual information: J&K’s indefinite internet bans were contested.  According to the SC’s ruling, internet access is essential to free speech and any limitations must be reasonable and short-term.  Principle: Digital area under government control must adhere to constitutional protections.
Ohio v. Brandenburg (1969, U.S.)  Facts: The speech of a Klan leader was illegal due to incitement.  Conclusion: The “imminent lawless action” criteria was established by the US Supreme Court.  Principle: Unless it provokes impending illegal action, political ideas are protected when advocated.
Taamneh v. Twitter, Inc. (2023, U.S.)  Facts: According to the relatives of ISIS attack victims, Twitter facilitated terrorist messaging.  In the absence of direct helping or abetting, the SC decided that platforms were not culpable.  Principle: Unless platforms intentionally support illegal activity, intermediary immunity endures.

(2021, EU)  Facts: Facebook’s data-driven political targeting was contested by consumer advocacy groups.  The EU Court maintained platforms’ duties to protect data rights in its ruling.  Principle: Platforms are held responsible for systematic political data misuse.
